The Food Labeling Modernization Act

On August 3, 2021, Representatives Pallone and DeLauro, along with Senators Blumenthal, Whitehouse, and Markey reintroduced the Food Labeling Modernization Act of 2021 (FLMA) to the House and the Senate.

The FLMA is a comprehensive effort to address numerous food labeling issues and includes amending FALCPA (Food Allergen Labeling and Consumer Protection Act) to require that food product packaging must disclose gluten-containing grains. This legislation would require that barely and rye be listed in the “Contains” statement and /or the ingredients on packaged food labels. Currently, wheat is the only gluten-containing grain that is required to be disclosed on food and beverage labels.

Food labels play an important role in managing celiac disease and other gluten-related disorders. For example, this change will allow consumers to know if the malt syrup or natural flavorings in their food contains barley.

In addition to reforming gluten labeling, the legislation will initiate a comprehensive overhaul to align often antiquated food labeling laws and regulations with the changing marketplace and the latest nutrition science.
